Terms and conditions
1. Introduction
1.1 These Terms and Conditions ("Terms") govern all services provided by Blissful Living Foundation Limited ("we," "us," "our," or "the Company"), a company incorporated under the laws of New Zealand, to you ("you," "your," or "the Client").
1.2 By engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
2. Services
2.1 We provide coaching services ("Services") including but not limited to:
a) Elite Coaching Programme
b) Strategic Breakthrough Sessions
c) Other coaching and consulting services as agreed in writing
2.2 The specific details, duration, and fees for Services will be outlined in a separate Service Agreement or Booking Confirmation.
3. Payment and Fees
3.1 Fees for Services will be clearly communicated and agreed upon before service commencement.
3.2 Payment terms, amounts, and currencies will be specified in your Service Agreement.
3.3 All fees are non-refundable unless otherwise stated in your Service Agreement.
4. Cancellation and Rescheduling
4.1 For the Elite Coaching Programme:
a) You commit to the full programme duration
b) Early termination fees may apply as specified in your Service Agreement
4.2 For Strategic Breakthrough Sessions:
a) 48 hours notice required for cancellation or rescheduling
b) Less than 48 hours notice may result in full fee being charged
5. Code of Conduct and Client Responsibilities
5.1 Group Coaching Values and Conduct
Participants in group coaching sessions agree to:
a) Maintain the highest standards of professional integrity
b) Treat all participants with respect, dignity, and kindness
c) Honour diverse perspectives and experiences
d) Support the growth and development of fellow participants
e) Maintain focus on constructive dialogue and solutions
f) Avoid self-promotion or solicitation within the group
g) Respect session times and participation guidelines
h) Share airtime equitably with other participants
i) Provide feedback in a constructive and compassionate manner
j) Honor the confidential nature of all discussions and personal information shared
5.2 Breach Consequences
Violation of privacy, confidentiality, or code of conduct may result in:
a) Written warning for first minor infractions
b) Fines of up to 100% of the programme price for serious breaches
c) Immediate removal from the group coaching programme
d) Service termination without refund
e) Legal action for breaches of confidentiality
The Company reserves sole discretion in determining appropriate consequences.
5.3 Client Responsibilities
5.1 You agree to:
a) Provide accurate information
b) Attend scheduled sessions punctually
c) Engage in the coaching process professionally and constructively
d) Complete agreed actions between sessions
e) Maintain confidentiality of group coaching sessions
5.2 You acknowledge that results depend on your engagement and implementation.
6. Confidentiality
6.1 We will maintain confidentiality of all client information as per our Privacy Policy.
6.2 Group coaching participants must maintain confidentiality of other participants' information.
7. Intellectual Property
7.1 All materials, methodologies, and content provided remain our intellectual property.
7.2 You may use materials for personal use only, not for commercial purposes.
8. Disclaimers and Limitations
8.1 Services are provided "as is" without any warranties, express or implied.
8.2 We do not guarantee specific results from our Services.
8.3 You acknowledge that:
a) Success depends on various factors outside our control
b) Coaching is not therapy, medical advice, or legal counsel
c) Decisions and actions taken are your sole responsibility
9. Liability
9.1 To the maximum extent permitted by law, we exclude all liability for any loss or damage.
9.2 If Section 9.1 is deemed invalid:
a) Our maximum liability is limited to the total amount paid by you for Services in the preceding 12 months
b) In no event shall our liability exceed USD $100,000
c) We are not liable for indirect, special, or consequential damages
10. Insurance
10.1 We maintain professional liability insurance.
10.2 Insurance details available upon reasonable request.
11. Term and Termination
11.1 We reserve the right to terminate Services if:
a) You breach these Terms
b) We reasonably believe continuing would be unlawful or harmful
c) We are unable to provide Services due to circumstances beyond our control
11.2 Termination does not affect accrued rights or liabilities.
12. Force Majeure
12.1 Neither party is liable for failure to perform due to circumstances beyond reasonable control.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by New Zealand law.
13.2 Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
14. Changes to Terms
14.1 We may modify these Terms at any time.
14.2 Continued use of Services constitutes acceptance of modified Terms.
15. Severability
15.1 If any provision is invalid, other provisions remain in effect.
16. Entire Agreement
16.1 These Terms, together with the Service Agreement and Privacy Policy, constitute the entire agreement between parties.
